Sacred Air Liability Waiver

PLEASE READ CAREFULLY BEFORE CHECKING THE BOX. THIS IS A LEGALLY BINDING DOCUMENT.
By checking the box and proceeding with payment, I (the "Participant") acknowledge and agree to the following terms:

 

1. Acknowledgment of Risk

I understand that participating in activities such as yoga, breathwork, meditation, sound baths, and related practices with Sacred Air Inc. (either in-person, online, or during live events) involves inherent risks, including physical injury, aggravation of pre-existing conditions, or emotional distress. I confirm that I do not have any medical conditions that would affect my ability to participate safely. If needed, I have consulted with a healthcare provider. I assume full responsibility for any risks of bodily injury, death, or property damage arising from my participation.

 

2. Voluntary Participation

I acknowledge that my participation in Sacred Air Inc. sessions is entirely voluntary. It is my responsibility to listen to my body, work within my limits, and inform the instructor of any discomfort or health concerns during the session.

 

3. Release and Waiver

In consideration of being allowed to participate, I hereby release, discharge, and hold harmless Sacred Air Inc., its owners, instructors, employees, volunteers, and agents from any claims related to injury, disability, death, or loss/damage to person or property arising from my participation, whether in-person, at a third-party location, or during online sessions.

 

4. Medical Treatment

In the event of an injury, accident, or illness during my participation, I consent to receiving first aid or medical treatment deemed necessary. I release Sacred Air Inc. from any claims related to such treatment, whether administered by its employees or third-party providers.

 

5. Online Class Considerations

I understand that online sessions may present additional risks due to the lack of physical supervision. I agree to ensure a safe practice environment at home. I also acknowledge that it is my responsibility to maintain proper internet connectivity, and Sacred Air Inc. is not responsible for service interruptions or technical issues.

 

6. Photography, Media Release & Collaboration with Brands

I grant Sacred Air Inc. permission to use photographs, video recordings, and other media taken during the session for promotional purposes, including collaborations with brands and Sacred Air Inc. for content sharing. This includes but is not limited to social media posts, website content, or other promotional materials. I understand that I can revoke this permission at any time by providing written notice.

 

7. Sound Bowl Therapy

I acknowledge that sound bowl therapy, which uses the healing vibrations and frequencies of singing bowls, promotes relaxation and well-being. I am aware of the following contraindications:

• Pregnancy: Consult a healthcare provider before participating, especially during the first trimester.

• Epilepsy: Individuals with a history of seizures should exercise caution.

• Mental Health Conditions: Consult a professional if you have severe anxiety, PTSD, or other conditions.

• Acute Illness or Injury: I will consult a healthcare professional before participating if I have an acute condition.

By choosing to participate, I confirm that I have read and understood these contraindications and will consult my healthcare provider if I have any concerns.

 

8. Consent to Use of Personal Information

By signing this waiver, I acknowledge and agree that I am providing Sacred Air Yoga and all its collaborative partners with explicit consent to collect, store, and use my email address for marketing purposes. This includes, but is not limited to, sending promotional materials, newsletters, product updates, special offers, and other commercial communications.

 

9. Children Under 18

For participants under the age of 18, a parent or guardian must sign this waiver and assume full responsibility for the child’s participation. The parent or guardian acknowledges that they have consulted with a healthcare provider to ensure their child’s health and safety during activities, and agrees to indemnify Sacred Air Inc. from any claims arising from the child’s participation.

 

10. Governing Law

This waiver shall be governed by the laws of the Province of Alberta, Canada. Any legal disputes will be resolved in the courts of Alberta.

 

11. Severability

If any provision of this waiver is deemed invalid or unenforceable, the remaining provisions will continue to be in full force and effect.

 

12. Entire Agreement

This waiver constitutes the entire agreement between Sacred Air Inc. and me regarding liability and risk. Any modifications to this agreement must be in writing and signed by both parties.

 

13. Acknowledgment of Risk

I understand that participating in wellness activities such as yoga, sound baths, meditation, and expert-led talks involves certain risks, including physical injury or discomfort. I voluntarily assume all risks associated with participation.

 

14. Health and Fitness Responsibility

I confirm that I am in good physical and mental health and capable of participating in the wellness activities offered at the Event. If I have any health concerns, I will consult a medical professional before participating. I am responsible for informing the event organizers of any pre-existing conditions or injuries that may affect my ability to participate.

 

15. Food and Beverages

I acknowledge that local vendors will provide food and non-alcoholic beverages at the Event. I recognize that some food may contain allergens or ingredients that could affect my health. I am responsible for informing the organizers of any dietary restrictions or allergies and waive any claims related to food or beverage consumption.

 

16. Expert Talks and Content

I understand that the expert-led talks and presentations are for educational purposes only and not medical advice. I am responsible for seeking professional advice regarding my health and well-being.

 

17. Release of Liability

In consideration of being allowed to participate in the Event, I waive, release, and discharge Sacred Air Inc., its employees, sponsors, contractors, volunteers, vendors, and all associated persons from any liability, claims, or causes of action arising from my participation, including injury, loss, or damage to person or property.

 

18. Indemnification

I agree to indemnify and hold harmless the Releasees from any claims or damages arising from my participation, including personal injury, property damage, or claims from third parties.

 

19. Voluntary Participation

I understand that my participation is voluntary, and I have the right to stop or modify my participation at any time without penalty.

 

20. Governing Law

This waiver will be governed by the laws of the Province of Alberta, Canada, and any disputes will be resolved within the jurisdiction of Calgary, Alberta.

 

By checking this box, I confirm that I have read, understood, and agreed to the terms of this waiver. I understand that by signing this waiver, I am giving up certain legal rights, including the right to sue the event organizers and their affiliates.

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY.
By completing payment, I confirm my consent to the Waiver and Release of Liability.
